1. Introduction
1.1 The XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and XIAOMI 14T PRO (12GB + 512GB) ("Campaign") website, https://xiaomi-14t-series.3ex.com.my ("Site"), is operated by Tri-E Multimedia Sdn Bhd [200901024741 (867841-X)] ("TEM"), an independent third party of Xiaomi Technologies Malaysia Sdn Bhd [202101002126 (1402424-W)] ("Xiaomi"). Xiaomi’s official dealers ("Dealer") shall honor the sales transaction with the customer (please refer to website for list of dealers). The terms and conditions stated herein ("Terms and Conditions") of this Campaign on which Xiaomi offers you ("Customer") access to and use of this Site for the purposes of this Campaign. Whilst the Campaign includes the pre-order of XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and XIAOMI 14T PRO (12GB + 512GB), the pre-order via the Site is provided by TEM as an independent third party. Xiaomi and its affiliates are not a party to the pre-order between the Customer and TEM. The Customer shall have no other cause of action or claim against Xiaomi under this Site.
1.2 Customer agrees to comply with all the Terms and Conditions when accessing or using this Site.
1.3 By participating in this Campaign and with the purchase of XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and XIAOMI 14T PRO (12GB + 512GB) at this Site, Customer will be entitled to free gifts which consist of:

1.4 The pre-order quantity in this Campaign is limited to first come first serve basis and subject to stock availability.
1.5 The sale transaction in this Campaign is only between TEM, the selected outlet and the Customer. Xiaomi only provides the recommended retail price and guidance on its website.

3. Duration
This Campaign will run from 19 September 2024, 15:00:00PM to 27 September 2024, 15:00:00PM ("Campaign Period"). TEM reserves the right to shorten, extend or cancel the Campaign Period without prior notice and while stocks last.
4. Eligibility
4.1 This Campaign is opened to public of 18 years old and above (as of 19 September 2024) with MyKad or passport.
4.2 Each Customer is only entitled to pre-order one (1) unit of either XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) or XIAOMI 14T PRO (12GB + 512GB).
5. Payment
5.1 Customer acknowledges, understands and agrees that all transactions are between Customer, TEM and the selected outlet only. Xiaomi only acts as the coordinating party and is not involved in any sale and purchase of this Campaign.
5.2 Customer is not allowed to cancel the pre-order, change the selected colour and/or model of the pre-ordered XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and/or XIAOMI 14T PRO (12GB + 512GB) as well as the selected collection outlet once Customer has successfully completed and confirmed the transaction.
5.3 Customer is required to place a deposit of RM100.00 ("Deposit") via credit card (Visa or MasterCard) through the Campaign’s website. The Deposit is not refundable and not transferrable.
5.4 If the Deposit is made by the Customer during the Campaign, the Customer shall pay the balance amount of the recommended retail price ("RRP") minus the rebate of RM300.00 (the rebate includes the RM100.00 deposit) for the unit ordered directly to the selected collection outlet upon collection.
6. Collection Date & Free Gift
6.1 If the order is successfully secured by the Customer during the Campaign, the Customer is required to collect and make the balance payment for the pre-ordered XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and/or XIAOMI 14T PRO (12GB + 512GB) during the operation hours from the selected collection outlet under the terms below:
6.2 Free Gift shall be given based on first come first serve basis, while stock last and to be collected during the Collection Period. Customer shall be advised on a given date or the next day to pick up the Free Gift should the Free Gift is not available on collection day.
6.3 TEM reserves the right to change the collection date without prior notice.

8. Limitation of Liability
8.1 TEM uses its reasonable effort to keep this Site safe, secure, and functioning properly, but TEM does not guarantee the continuous operation of or access to this Site.
8.2 Customer agrees that he/she is making use of this Site at his/her own risk, and that it is being provided to Customer on an "AS IS" and "AS AVAILABLE" basis.
8.3 To the extent permitted by applicable law, TEM excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.4 Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Campaign.
8.5 Customer shall be deemed to have performed a legally binding contract upon his/her submission of the pre-order and there shall not be any refund or costs whatsoever arising from his/her violation of the minimum age stated herein.
8.6 Warranty of the XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and XIAOMI 14T PRO (12GB + 512GB) is subject to standard product warranty coverage as per terms and conditions of the warranty as stated in Xiaomi’s official website at https://www.mi.com/my/service/warranty. Customer is advised to check the abovementioned website from time to time and stay informed for any changes on the terms and conditions of the warranty.
8.7 All transportation, personal costs and/or any other costs, fees and/or related expenses arising out of the collection of the pre-ordered XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and/or XIAOMI 14T PRO (12GB + 512GB) are the Customer's sole responsibility.
9. Indemnity
Customer will fully indemnify and hold TEM and Xiaomi (and our affiliates, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself/herself or any third party due to or arising out of his/her breach of these Terms and Conditions, improper use of the site or breach of any law or the rights of a third party.
10. Privacy
By providing Customer's personal data, Customer is indicating that he/she has read, understood and agreed that his/her personal data will be recorded, stored or otherwise processed in accordance to the Privacy Policy stated on this Site.
11. General

11.2 TEM reserves the right to make amendments to the Terms and Conditions of the Campaign herein without prior notice.
11.3 Access to any third-party websites is solely at the Customer’s risk and TEM assumes no liability and is not responsible for any content, the accuracy or reliability of any products, services, information, data, opinions, advice or statement made on these linked websites. Nor is TEM liable for any security or security practices of these third-party websites. Use of these third-party websites are entirely at the Customer’s own risk. The inclusion of any links does not imply any endorsement in any form on the part of TEM.
11.4 TEM reserves the right to disqualify any submissions for pre-order in the event of violation of any of the Terms and Conditions.
11.5 In the event of any discrepancies between the information that Customer has submitted with regards to the pre-order and the information provided during collection of the XIAOMI 14T (12GB+256GB), XIAOMI 14T (12GB+512GB), XIAOMI 14T PRO (12GB +256GB) and/or XIAOMI 14T PRO (12GB + 512GB) at the selected collection outlet for any reasons whatsoever, TEM shall not be responsible for any loss or costs arising from such discrepancies howsoever caused.
11.6 In case of any dispute, TEM reserves the right to make the final decision and shall have the right to cancel, disqualify the pre-order and/or forfeit the deposit necessarily.
11.7 By participating in this Campaign, Customer fully and unconditionally agrees to and accepts the Terms and Conditions stated herein. Customer agrees to be bound by and abide to the Terms and Conditions stated herein including any amendments, modifications and /or interpretation thereof.
11.8 TEM reserves the right to modify the Terms and Conditions stated herein without prior notice, at its sole and absolute discretion.
11.9 In the event of an electronic, computer, operational and/or technical error affecting the details, pricing or quantity of the product on the website, TEM reserves the absolute right to rectify such error and/or cancel any transaction which has been entered into in reliance of the said error.
11.10 If any of the Terms and Conditions stated herein shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity and unenforceability of such terms and conditions shall not affect the other provisions and all provisions not affected by such invalidity and unenforceability shall remain in full force and effect.
11.11 By participating in this Campaign, Customer agrees to grant TEM and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies the use of his/her full details submitted through this Campaign, without further compensation, unless prohibited by law.
11.12 In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Campaign (if any) and the Terms and Conditions herein, the latter shall prevail.
11.13 These Terms and Conditions herein shall be governed by the laws of Malaysia and the jurisdiction of the courts of Malaysia.
